Fonx Solutions operates in the healthcare sector and takes compliance seriously. When providing services that involve access to Protected Health Information (PHI) on behalf of a Client, Fonx Solutions acts as a Business Associate under the Health Insurance Portability and Accountability Act (HIPAA).
A signed Business Associate Agreement (BAA) is required before Fonx Solutions will access, process, or handle any Protected Health Information (PHI) on a Client's behalf. This BAA is executed separately from these Terms of Service as part of the client onboarding process.
Clients are responsible for ensuring their own HIPAA compliance, including but not limited to properly training staff, maintaining appropriate safeguards, and ensuring their own systems and workflows meet applicable regulatory requirements. Fonx Solutions' services support operational oversight but do not replace the Client's own compliance obligations.
Nothing in these Terms of Service or in any communications from Fonx Solutions constitutes legal compliance advice. Clients are encouraged to consult qualified healthcare compliance counsel for guidance specific to their practice and jurisdiction.
